Walk into any eleventh grade classroom in Virginia. If Attorney General Ken Cuccinelli (R-VA) has his way, close to forty percent of the students will be felony sex offenders.

Dahlia Lithwick breaks down the implications of Cuccinelli’s plan in a must-read piece over at Slate. In short, Cuccinelli’s petition asking the Supreme Court to reinstate much of Virginia’s so-called “crimes against nature” law — which criminalizes oral and anal sex — is unlikely to impact adults who have sex with adults because the Court’s previous decision in Lawrence v. Texas held that the Constitution protects non-commercial sexual activity among adults. The tea partying attorney general’s petition, however, largely relies on a line in Lawrence suggesting that underage sexual activity can still be criminalized.

As Lithwick notes, “44 percent of males and 42 percent of females between the ages of 15 and 17 have engaged in oral sex in the United States.” While it’s undoubtedly true that a minority of these teenagers are engaged in oral sex with someone much older, the overwhelming majority of them are partnering with each other. And since Cuccinelli’s proposed rule would make no exception for teens who have oral sex with other teens, every single high school student who does so would become a felon and a sex offender.

It criminalizes sex. Virginia, where I live, is engaged in a horrible gubernational battle (arent all political campaigns in America horrible?). Apparently 30 people are on the sex offenders register for engaging in concential adult oral and anal sex - the Democrat wants to overturn that and the Republican is running with an ad campaign saying that the Democrat wants to release sex offenders. Its freekin retarded.

It criminalises anal and oral, the two main sex acts homosexual men can indulge in, given gay men don't ordinarily have vaginas. This is a very, very old tactic which has been used to attempt to criminalise homosexuality via the 'back door' (no pun intended) many times before.

Yeah, its clearly aimed at homosexuals but is written so badly that it covers just about anyone.

 

Technically it's intended to cover everyone. He's going to have a hard time coming out and saying that, "Hey.. I don't want gay guys fucking!" because then he would just look like a bigoted, ignorant, homophobic fuck... which of course he is. But if he says he doesn't want anyone getting anal or oral then he can't be accused of being a bigoted, ignorant homophobic fuck... which of course he is.

 

In practice it's a law that will be purely be used against gay men.

 

Without even looking, because I know the answer before I research it.... what do you think the ratio of homosexual to heterosexual couples is when it comes to sodomy law convictions?

 

I'd take a wild stab (pun indented) at hundreds to one... if there even has been one.
