No, it's you who's missing the point.

 

Not enough evidence to prove "beyond reasonable doubt" in a Criminal case but there's enough evidence to prove based on the "balance of probabilities" required in a Civil case.

 

It's pretty simple to understand.

It's basically the judge guessing what happened. Not exactly fair. Civil court should be for civil offences, not crimes like rape.

I think thats what everyone is struggling with. Would you see a murder (obviously with the grieving family claiming damages) go through civil court?

 

It seems to be that the judge sided not on evidence given but with the quality of witness. Being a good witness can win you a civil case and being branded a rapist without conclusive is a dangerous precedent to set.

 

And I'm not saying either party is innocent or guilty in this I just think it should be a matter for criminal courts only.

Possibly the most famous murders in history resulted in a civil case and award. OJ Simpson was taken to a civil court by Ron Goldman's family and forced to make a massive pay out.

But in fact, it goes well beyond this because it's more if a case of :

 

Dont even shag drunk women if they consent as they might change their mind the following day and turn against you.

 

Makes you wonder if the same would apply to a guy who was that drunk and a woman insisted he have sex despite him not "being fit to consent"?

Totally disagree with civil court being used to find someone guilty of a crime that a criminal court said they couldn't take anywhere, especially something as absolutely destroying to a person's reputation as this.

If he raped someone, then a judge should have said let's roll in criminal court. Let the peers do their thing, find guilty and sentence the bastard.

Instead some judge thinks yeah he probably did it and he is now a rapist and out to the tune of a lot of money. He's done.

 

Rape is terrible - I've known too many women who have been raped and it's sickening - but this is also bad. There's no justice here.

Aye, and as far as I can see Goodwillie and Robbertson are now rapists but not criminals. It just seems daft, and I know the courts and required evidence are different, that they're now both viewed as rapists without the required evidence.

 

 

Rapists should be given punishment, of that there's no doubt and bringing them to justice more often is a good thing, but requiring less evidence to do so isn't a wholly positive move as far as I can see.

I had an annoying ex who would constantly pull my penis out my trousers to suck it or wank it when I was blootered despite me aggressively telling her to "fuck off", " piss off" etc. She used the rule of thumb that if my penis went erect I was a consenting adult, even if I was unconscious.
