Fridge
Coppers stopping folk this morning for random checks and someone I know got done. Slightly over the limit on a Monday morning. Have they nae got anything better to do. Not condoning it at all but being Bluto’d @bluto out of your face on a Saturday night and driving home is clearly a risk to the public and totally unacceptable. Being a bit rough on a Monday going to work after a weekend sesh, unless you are driving erratically or something is harsh. Link to comment

Fridge
So, genuine question, where do you draw the line?Suppose my point was that they are targeting stats. Somebody driving to work slightly over the limit after a night out is not a threat compared with somebody driving home after 8 pints. It is the law and if you were to get pulled after even 2 pints on a night out you’re fair cop. But going for folk on a Monday morning when they are perfectly capable of driving in my opinion is poor. Stop folk randomly on Saturday nights when they are a major threat to themselves or someone else. Link to comment

If there is a limit where you are deemed to be unsafe to drive, it doesn't really matter when you are over it surely? Unless you are suggesting you are more impaired if you are over the limit on a Saturday night than you are if you are on a Monday morning? Link to comment

Fridge
I’ve had a bit of a mare here and should have realised folk would have lost folk through drink driving. My point was that there is a difference between knowingly getting behind the wheel pished and being slightly over the limit the next day. Regardless if you are over the limit no excuses. Andy_123
I agree with the OP that going for folk on a Monday morning is more to do with police trying to inflate their own statistics rather than making a serious effort to actually cut down on dangerous drunk driving. IMO there should be different categories of charges for drink driving. How can driving hungover on a Monday morning and being ever so slightly over the limit be classed the same as driving straight home from the pub and being 4/5 times the limit? I've driven hungover the morning after a night out, like 99% of people on here will have. Does that mean we all deserve to be labelled as drink drivers? Link to comment

Andy_123
If you fail the breath test and are convicted then yes it does. So you think someone who doesn't drive while on their night out but is still slightly hungover the day after should be treated and forever classed the same as someone who can't see straight and jumps in the car to drive home from the pub immediately after sinking 10 pints? There should definitely be different grades of charges for drink driving based on how over the limit you are and the circumstances. Link to comment

When the Scottish limit was reduced, I got a home breathaliser and it is a fair eye opener, how long it takes alcohol to get out of the system at times. I'm glad I spent most of my 20s without a car on that basis. You can be hungover without still being above the limit, so that isn't the relevant point. Think the main point is either know what you are doing, if you don't, find out, and if you can't, then accept the risks that go with possibly driving over the limit. They are well documented nowadays, so you have to be a fair idiot to complain about being caught out the day after when there is so much information about it. Link to comment

There are different grades in the fines and punishments dished out for such things. Related to level of drink, likely timings, and effects of driving under the influence (i.e. damage/injuring folk). Why the offence should be any different, I don't know. Person drives car while under the influence of alcohol. It's your own responsibility to know if you are or aren't, and it ain't that difficult nowadays. Link to comment

Foster14
There are already different levels of punishment depending on how much over the limit you are . That's what I said. I think he is suggesting there should be an "Oops, I am over the limit the day after" charge and an "I've driven straight home from the pub after a few" charge. Or more likely a grading based on how drunk you are at the time of being caught, as that doesn't seem to appear in the "headline" charge. Link to comment

Redstar
Seldom do the Yanks ever have a good idea but in this instance the way they treat folks that are just over the limit is different...well it is in Texas. One of my mates was caught over there and now has to blow into a breathalyser to start his 5.0l Mustang...at his own expense he is allowed to have the breathalyser and camera (to make sure its the driver that's doing the blowing) fitted...around $3k to have it all done but crucially he kept his licence and his job...
