A young mum who says she was raped by footballer David Goodwillie has won legal aid to sue him.

Denise Clair, 27, has been told the £500,000 civil action against Goodwillie and fellow footballer David Robertson will be paid for by the taxpayer.

Now 25-year-old Goodwillie and Robertson could be questioned about the case in court.

Goodwillie, who has categorically denied any wrongdoing, was charged with rape by police but the case against him was dropped before it reached court.

Robertson, 27, who was questioned by police but never charged, is named in papers lodged in court by Denise’s legal team.

She said: “I’m delighted Legal Aid have decided to fund the case. All I’ve ever wanted is the evidence heard in court.

“My life fell apart after the Crown Office suddenly dropped the criminal charge against Goodwillie. I’ve continued to fight because I need to know what happened to me and who is responsible.”

Former Scottish Prison Service education adviser Denise bumped into Goodwillie and former school pal Robertson during a night out in Bathgate on January 1, 2011.

She remembers nothing but waking up naked and alone in a flat in Armadale, West Lothian, the next day, believing she had been raped.

The case was dropped but the Criminal Injuries Compensation Authority ruled Denise was a victim of crime and paid out £11,000 – the highest possible award. Earlier this year, the Sunday Mail spoke to eyewitnesses who said Denise was “100 per cent” incapable of giving consent.

The law was changed in 2009 to make it clear that any woman who is incapable through drink or drugs could not consent to sex.

Goodwillie – who signed for Aberdeen in July – and Robertson took Denise from Chalmers nightclub in Bathgate in a taxi after promising concerned stewards they were taking her home.

Stewards say she was stumbling around with no shoes, had lost her coat and bag and was incoherent with her eyes “rolling about in her head”. Tests showed an almost fatal level of alcohol in her system.

In July 2011, the Crown Office said the rape charge was being dropped due to “insufficiency of evidence”.

Days later, Stirling-born Goodwillie was signed by Blackburn Rovers from Dundee United in a £2.8million deal.

Denise’s lawyer Cameron Fyfe said: “Denise wanted the evidence tested in court and a civil action is now her only route to do that.”

In a letter, the Scottish Legal Aid Board stated: “The application for civil legal aid has been granted.”

Goodwillie’s lawyer Liam O’Donnell said: “The Crown were aware of all the evidence and correctly decided not to raise a prosecution. David will vigorously defend any court action.”

Livingston FC player David Robertson declined to comment. He has applied to Legal Aid to defend the action.

I wasn't there. I don't know what happened.

 

What I do know is that a friend of mine who has personal knowledge of Goodwillie describes his character as "poison".

 

These allegations, if proved, would therefore not surprise me.

Nor me, however the lassie had near fatal levels of alcohol in her system , is robertson up for rape also , or just goodwillie ?

 

Sounds like a bizarre case... given that she cannot remember what happened, surely there can be no conviction? You can't convict someone of the basis of 'a belief'. To be honest, I reckons it's a shamble that she can be allowed to drag DG's name through the mud like this.

Bizarre.

 

Is there any physical evidence that she even had sex with him? Was a rape kit preformed? What did it show?

 

If you're too incapacitated to give consent through drink/drugs and there is DNA present, then fair enough, but is there any evidence Goodwillie even touched her?

 

The case will be dropped due to lack of evidence - again!

The legal aid system is fucked up, I got arrested in March this year for something I didn't do, got refused legal aid 3 times, every time racking up more legal bills, case got dropped before it went to trial, my legal bill £900 fecking quid, joke of a system. I knew all along I'd done nothing.

 

I have no come back to the copper who lifted me and kept me in a cell for hours despite no evidence, he admitted I got arrested as he recognised me, he gave me a lift home as I had no money on me and he was based in Bucksburn, in the car he acted like old mates asking if I knew so and so.

 

The system is fucked, she smells cash.

 

Like the girl who went back to Tysons hotel room, honestly what are you expecting to happen?? tea and scones??

Terrible if she's been raped and you can only assume (since none of it is out there) that no rape kit was done. Otherwise their DNA would have been pretty apparently inside her. And combined with her being mind-blowingly drunk it would have been a stick on rape.

 

Since there wasn't enough evidence there obviously wasn't DNA in her.

 

And if there wasn't that... then I don't see any other alternative how there could have been rape?

 

Maybe the guys are scumbags who got away with it but rape would leave DNA and a test would reveal it, end of story.

 

That leaves if the cops didn't do that or she didn't consent to it then *shrug* nowhere to go.

 

Dislike strongly that someone can have no case to answer for but the alleged victim gets the largest payout available though. Nasty.

Doesn't matter what you or I think cheesepipes. That's the law now. (And I disagree with it too... if they're both drunk somehow the guy would still be done with rape in that circumstance)

 

But since she WAS blitzed and therefore any sex with her = rape in the eyes of the law... and they DIDNT prosecute, it seems pretty obvious there was no signs of sex.

Assume the bloke can put in a counter-claim that she raped him in that case?
