Again, nobody knows what exactly happened that night and if she was passed out on the bed then she is incapable of giving consent in the eyes of the law and as such any sex with her would be without consent and therefore rape. Which I think means the decision not to prosecute had to be based on the absence of a considerable amount of evidence against DG if the above is correct as there could be little arguments over her being "up for it."

 

As F&D says, the lassie is putting herself in the firing line by bringing any case against the two guys and she clearly has had legal advice over this so if there was absolutely nothing in it she should have been advised to leave it well alone.(see T Sheridan)

It's all IFs at the moment either could be talking complete & utter sh*te & just as easily it could be one or two or even all three are talking sh*te at the moment & it's all blown up out of all proportion.

 

Nobody but them know fully what went on, so we'll have to wait until the real nitty gritty comes out (& let's all hope it really does come out) so until then it's wrong to fully take the side or sides of any of them in this case & especially from any kind of sexist view.
